Terms of Service

• FACTEL: SaaS electronic invoicing, DTE reception, analytics, and business intelligence platform, owned by INVENIA.

• INVENIA: company that develops and operates FACTEL, located in Santa Tecla, La Libertad, El Salvador.

• User: any individual or legal entity that registers and uses the platform.

• DTE: Electronic Tax Document, as defined by the Ministry of Finance of El Salvador.

• Plan: subscription level contracted by the user (Starter, Business, Enterprise).

FACTEL is a platform that enables:

• Issuance of electronic tax documents (DTEs) in compliance with current regulations.

• Automatic reception and classification of supplier DTEs using artificial intelligence.

• Centralized purchase and sales management.

• Access to analytical dashboards and business intelligence.

• Platform integration with ERP and CRM systems through a documented REST API.

The specific scope of features depends on the contracted plan.

To use FACTEL, you must:

• Provide truthful, complete, and up-to-date information during registration.

• Maintain the confidentiality of your access credentials.

• Immediately notify any unauthorized use of your account.

• Be of legal age and have the legal capacity to contract.

You are responsible for all activities performed under your account.

• Available plans and pricing are detailed in the Pricing section of the platform.

• The free plan (Starter) includes limited features and a restricted number of monthly DTEs.

• Paid plans are billed monthly or annually, depending on the chosen modality.

• Prices may change with at least 30 days prior notice.

• Non-payment may result in service suspension or cancellation.

You agree to:

• Use FACTEL exclusively for lawful purposes and in compliance with current tax regulations.

• Not issue fraudulent tax documents or documents containing false information.

• Not attempt to access other users' data or compromise platform security.

• Not use the platform for money laundering, tax evasion, or other illegal activities.

• Not reverse engineer, decompile, or attempt to extract the platform's source code.

• FACTEL, its brand, logos, source code, design, algorithms, and artificial intelligence are the exclusive property of INVENIA.

• Fiscal data entered by the user is the user's property. INVENIA acts as a processor of this data in accordance with the Privacy Policy.

• Reproduction, distribution, or creation of derivative works from the platform without written authorization is prohibited.

• INVENIA strives to keep FACTEL available 24/7, with a target availability of 99.9%.

• Maintenance windows may be scheduled with prior notice.

• INVENIA shall not be liable for interruptions caused by force majeure, third-party failures, or events beyond its reasonable control.

• FACTEL is provided "as is" and "as available."

• INVENIA does not guarantee that the platform will be uninterrupted, error-free, or meet specific user requirements not contemplated in the contracted plan.

• INVENIA's total liability for any claim shall not exceed the amount paid by the user in the last 12 months.

• INVENIA shall not be liable for indirect, incidental, special, or consequential damages.

• Use of the platform does not constitute tax, legal, or accounting advice. The user is responsible for meeting their tax obligations.

• FACTEL operates under the Electronic Tax Documents (DTE) regulations of the Ministry of Finance of El Salvador.

• INVENIA keeps the platform updated with regulatory changes, but the user is responsible for verifying compliance with their specific tax obligations.

• FACTEL facilitates tax compliance but does not replace the advice of a tax accountant or attorney.

• The user may cancel their account at any time from the platform settings.

• INVENIA may suspend or cancel accounts that violate these Terms, with prior notice when reasonably possible.

• After cancellation, fiscal data will be retained in accordance with current regulations (see Privacy Policy, §7).

• No refunds will be issued for unused partial periods, except as required by applicable law.

These Terms are governed by the laws of the Republic of El Salvador. Any disputes shall be submitted to the competent courts of San Salvador, El Salvador, unless applicable law provides otherwise.

INVENIA reserves the right to modify these Terms. Substantial changes will be notified at least 30 days in advance. Continued use of the platform after changes take effect constitutes acceptance thereof.
